Terms of Service (Beta) – Relicxs (Lightweight)
These Terms of Service (“Terms”) govern your access to and use of the Relicxs website and services (the “Services”). Relicxs is a trade name of The Next Ten (“Provider”, “we”, “us”).
If you or your organization has signed a Master Services Agreement (MSA), Order, or other written agreement with The Next Ten that covers the Services, that agreement governs and will control in case of conflict with these Terms.
1) Beta services
The Services may be offered as beta or early access. Beta features may change, be unstable, or be discontinued.
To the extent permitted by law, beta services and AI outputs are provided “as is” and “as available”.
2) Accounts and eligibility
You must be at least 16 years old to use the Services. You are responsible for maintaining the confidentiality of your credentials and all activities under your account.
3) Your content (Customer Data)
You retain ownership of content you upload or store in the Services (“Customer Data”).
You grant us a non-exclusive, worldwide license to host, copy, process, transmit, display, and create derivative works from Customer Data only as needed to provide and support the Services and comply with law.
You are responsible for ensuring you have the necessary rights to upload and use Customer Data, including copyright, licensing, privacy/publicity rights, and any required permissions.
4) AI outputs
The Services may generate suggested metadata, tags, captions, or other outputs using machine learning (“AI Outputs”). AI Outputs are probabilistic and may be incorrect, incomplete, or biased. You are responsible for review where accuracy matters.
Model training: By default, customer-provided content is not used to train or fine-tune models for other customers. We may use aggregated or de-identified usage data to improve performance and reliability.
5) Acceptable use and restrictions
You agree not to:
- Reverse engineer, decompile, or attempt to discover the source code of the Services
- Access the Services for the purpose of building a competitive product
- Remove proprietary notices
- Upload, store, or transmit malware, illegal content, or content that infringes or violates third-party rights
- Perform penetration tests or load tests without our prior written consent
- Resell or provide the Services to third parties unless we agree in writing
6) Prohibited sensitive data
Do not upload special categories of personal data under GDPR, government IDs, or other highly sensitive personal data unless explicitly agreed in writing.
7) Suspension and termination
We may suspend or terminate access if we reasonably believe there is a security risk, unlawful or infringing content, abuse, or a material breach of these Terms. We will restore access when the issue is resolved where reasonably possible.
You may stop using the Services at any time.
8) Disclaimers
To the maximum extent permitted by law, the Services and AI outputs are provided without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9) Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, goodwill, or data.
Our total liability relating to the Services is limited to the amounts you paid us for the Services in the 12 months before the claim (or EUR 100 if you paid nothing).
10) Governing law
These Terms are governed by the laws of The Netherlands. Courts in Amsterdam have jurisdiction, unless mandatory law provides otherwise.
